The Lagos State Government which has hitherto enforced the Lagos State Physical Planning Permit Authority, (LASPPPA) and the Lagos State Building Control Agency(LABSCA) laws on private property seems to have gone haywire in the quest to maximize profits in the Lekki axis on the development of a residential property on Igbokosu Road also known as Platinum Road, Lekki, Lagos.
The state government, which is developing the property through the Lagos State Development and Property Corporation(LSDPC) in conjunction with some six private firms is building terraces in reckless violation of the required setbacks prescribed by the LASPPPA and LASBCA laws for road setbacks.
In Lagos State, road setbacks for building permits generally range from 3 meters to 9 meters, depending on the type of structure (residential, commercial, or mixed-use) and the road classification.
Specific requirements are outlined by the Lagos State Physical Planning Permit Authority (LASPPPA) and the Lagos State Building Control Agency (LASBCA) as follows: Residential structures 6 metres; Substandard 3 metres on one side, Special Schemes 9 metres.
Our investigation revealed that the structure in question did not even leave a setback of 2 metres even when the structure falls within a special scheme that requires setback of not less than 9 meters.
More worrisome is the fact that while all the private properties on the road have built within the required setbacks, only the Lagos State Government is embarking on this shameful violation of its own laws in a bid to maximize profits.
The Lagos State Government is embarking on the project in association with Annuva, CCES, SPACE and three other companies after sand filling what seems to be canal in the axis.
